In the suit filed in Abuja, Edema was  seeking an order of the court to declare illegal, null and void, the  list of the Niger Delta Development Commission board members sent by  Jonathan to the Senate last week.
He also sought a declaration of the  court that the people of the oil producing area of Ondo State deserved  the position of an executive director in the new board of the NDDC,   being the fifth largest oil producing state in the country.
Edema, therefore, asked the court to  restrain Mark and the Senate from screening or confirming the list of  the board sent to it by the President.
He further asked the court to prevent  the Senate from considering or screening any list that might be sent to  the Senate by Jonathan in future, which would not include the name of an  Ondo State indigene as an executive director in the proposed NDDC  board.The lawmaker also prayed the court to  restrain the President from inaugurating the nominees contained in the  NDDC list before the Senate without the inclusion of an indigene of the  oil producing areas of Ondo State as either the managing director or an  executive director.
Edema supported his originating summons with a 26-paragraph affidavit.
No date has been fixed for hearing.
It will be recalled that Jonathan, in a  letter to Mark last Wednesday, urged the Senate to approve the  appointment of Senator Bassey Ewa-Henshaw from Akwa Ibom State as the  chairman of the proposed  NDDC board and Mr. Bassey Dan-Abia as the  Managing Director.
Jonathan also named Mr. Itotenaan Ogiri  as Executive Director,  Finance and Administration; Mr. Tuoyo Omatsulu  as Executive Director, projects; while Mr. Olorungbonju Enikuomehin  was  nominated as the Ondo State representative on the board.
